Welcome to PinkBook VIP (“Platform”, “we”, “our”, “us”).
These Terms and Conditions (“Terms”) govern the use of our website, the creation of profiles, and the purchase of Free, Premium, and VIP plans.

By accessing or using PinkBook, you agree to these Terms and conditions our Privacy Policy.
If you do not agree, please do not use the Platform.

1. Definitions

  • Advertiser: an individual or entity who creates a profile and publishes content or offers on the Platform.

  • User: any visitor who browses, searches, or interacts with profiles.

  • Plan: a subscription or listing tier (Free, Premium, or VIP) with specific features and durations.

  • Content: any text, images, videos, links, or materials uploaded by the Advertiser.

2. Role of PinkBook (Marketplace/Directory)

PinkBook is an online directory and digital marketplace connecting independent advertisers with users.

We are not an agency, employer, intermediary, or service representative, and we do not participate in any direct arrangements between Users and Advertisers.

Advertisers are solely responsible for the accuracy, legality, and delivery of their own content and services.
PinkBook does not endorse or share the opinions expressed in Advertiser profiles.

3. Eligibility and Account

  • You must be 18 years or older to create a profile or use the Platform.

  • You are responsible for maintaining the accuracy of your details and the security of your password.

  • We reserve the right to suspend, refuse, or terminate accounts at our discretion if these Terms are violated — without refund in case of material breach.

4. Plans, Pricing, and Duration

  • PinkBook offers Free, Premium, and VIP plans with different features and durations, as described on the Plans page.

  • Prices, features, and durations may change and will always be clearly displayed before purchase.

  • Automatic renewal (where applicable) will be disclosed at checkout.
    You may cancel renewals at any time before the next billing cycle.

  • Advertisements become active after payment confirmation (if applicable).

5. Editing, Pausing, and Moderation

  • We may resize or format uploaded images for display optimization.

  • Excessive or repetitive content changes may be restricted.

  • All listings are subject to review before publication and may be edited, hidden, or removed if found in violation of our policies or applicable laws.

  • To edit, pause, or permanently delete your profile, you must contact the PinkBookVIP administrative team directly at admin@pinkbookvip.com. Requests will be reviewed and processed within a reasonable timeframe.

6. Advertiser Obligations

By submitting content or creating a profile, you confirm that:

  1. You own all rights to the materials provided and do not infringe on any copyright, image, brand, or privacy rights.

  2. You do not impersonate others or use another person’s photos or identity.

  3. You comply with all applicable laws, including but not limited to:

    • Competition and Consumer Act 2010 (Cth)

    • Fair Trading Acts (state and territory)

    • Privacy Act 1988 (Cth) and Australian Privacy Principles

    • Anti-discrimination and human rights legislation

  4. You only advertise in jurisdictions where you are legally permitted to operate.

  5. You maintain your profile as truthful, accurate, and up-to-date.

  6. You do not abuse the Platform by redirecting traffic to competitors or unauthorized websites.

  7. You do not publish material that is illegal, offensive, defamatory, obscene, misleading, discriminatory, or harmful.

Image/identity verification: PinkBook may request photo or document verification to prevent fraud. Profiles with inconsistent information may be suspended until clarified.

7. License to Use Content

By submitting content, you grant PinkBook a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, resize, and display your materials solely for the purpose of promoting your profile and the Platform (website, email, and social media).
You may delete your content at any time; however, the license remains in effect for materials already published or archived in system caches.

8. Payments, Billing, and Refunds

  • Payments are processed securely through third-party payment providers (e.g., Stripe, WooCommerce Payments).

  • Taxes (GST and others) may apply and will be shown at checkout.

  • Refund requests must be emailed to admin@pinkbookvip.com, including your order number, reason, and any supporting details.

  • Refunds are not provided for change of mind, non-use, or breach of Terms.

  • Subscription cancellations take effect from the next billing cycle (no pro-rata refunds unless required by law).

9. Prohibited Content and Legal Compliance

You must not upload or publish any content that:

  • violates advertising, consumer, privacy, or IP laws;

  • is fraudulent, misleading, spam, or malicious;

  • promotes illegal activity or harms others.
    PinkBook may remove content or suspend accounts at any time for violations or legal risks.

10. Reporting Content

Users may report offensive, misleading, or illegal content by emailing admin@pinkbookvip.com.
Reports are reviewed promptly, and PinkBook reserves the right to remove or edit content at its sole discretion.
Our moderation decisions are final.

11. Disclaimers and Limitation of Liability

  • The Platform is provided “as is”, without warranties of uninterrupted service or specific outcomes.

  • We do not verify or guarantee the accuracy of Advertisers’ information or identity.

  • All interactions and transactions between Users and Advertisers are at their own risk.

  • To the fullest extent permitted by law, PinkBook shall not be liable for indirect, incidental, or consequential damages, including lost profits or data.

  • If liability cannot be excluded, our total obligation will be limited to resupplying the service or reimbursing its equivalent cost.

  • You agree to indemnify and hold harmless PinkBook, its staff, and affiliates from any third-party claims arising from your use of the Platform or violation of these Terms.

12. Intellectual Property

All website design, layout, logos, code, trademarks, and visual materials are owned or licensed by PinkBook.
You may not copy, redistribute, modify, or create derivative works without written permission.
Printing or saving content for personal use only is allowed.

13. Security, Links, and Restricted Use

  • While we implement reasonable security measures, internet transmissions can never be fully secure.

  • PinkBook is not responsible for any damage caused by data breaches or unauthorized access.

  • The Platform may include external links, but PinkBook does not control or endorse third-party websites or their policies.

  • Automated scraping, bots, data mining, or reverse engineering of the Platform is strictly prohibited.

14. Suspension and Termination

PinkBook may suspend or terminate accounts at any time for violations of these Terms, suspected fraud, legal orders, or technical issues.

Any clauses related to indemnification, IP, or limitation of liability will survive termination.

15. Updates to the Terms

PinkBook may update these Terms at any time.
The effective date will be shown at the top (“Last Updated”).
Your continued use of the Platform constitutes acceptance of the updated version.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia, and, where applicable, the Commonwealth of Australia.

You agree to submit to the exclusive jurisdiction of the courts in Victoria.
